Terms of Service

These Terms of Service (“Terms”) govern your access to and use of HireTrack (“the Service”), operated by TalkyTools. By creating an account or using the Service, you agree to these Terms.

1. Account Registration

You must provide accurate, complete information when registering. You are responsible for maintaining the confidentiality of your password and for all activities under your account. Notify us immediately of unauthorized access.

2. Acceptable Use

You agree NOT to:

  • Use the Service for any illegal purpose or in violation of any law.
  • Upload candidate or employee data you are not authorized to process.
  • Attempt to gain unauthorized access to other organizations' data.
  • Reverse-engineer, scrape, or stress-test the Service.
  • Use the Service to send unsolicited communications (spam) to candidates.

3. Data Ownership

You retain ownership of all data you upload (candidates, employees, jobs, payroll). HireTrack is granted a limited license to host, process, and display this data solely to operate the Service for your organization.

4. Plans, Billing & Subscriptions

Currently free during launch promotion. Paid plans, when introduced, will be billed monthly or annually in advance. You authorize automatic renewal unless cancelled before the renewal date. Prices are exclusive of applicable Indian GST.

5. Service Availability

We aim for 99% monthly uptime but do not guarantee uninterrupted service. Scheduled maintenance may occur. We are not liable for damages arising from downtime, data loss, or third-party service interruptions.

6. Statutory Compliance Disclaimer

HireTrack provides tooling to compute Indian payroll, PF, ESI, Professional Tax, and TDS based on standard rules. You are responsible for verifying calculationsagainst your specific statutory obligations and consulting a qualified Chartered Accountant. We are not liable for filing errors or penalties.

7. Termination

Either party may terminate at any time. We may suspend accounts that violate these Terms. Upon termination, you may export your data within 30 days; after that, data may be deleted.

8. Limitation of Liability

To the maximum extent permitted by law, HireTrack's total liability is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, or punitive damages.

9. Indemnification

You agree to indemnify HireTrack against claims arising from (a) your misuse of the Service, (b) your violation of these Terms, (c) the data you upload, or (d) your violation of any third party's rights.

10. Intellectual Property

The HireTrack platform, branding, and code are owned by TalkyTools. You may not copy, modify, or redistribute any part of the Service without written permission.

11. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Disputes shall be subject to the exclusive jurisdiction of courts in Maharashtra, India.

12. Changes to Terms

We may update these Terms with at least 30 days' notice for material changes. Continued use after changes constitutes acceptance.
